Hex Partners v Carter et als, Docket No: ESX L 246-10 (Law Division Essex County) The Lombardi Law Firm challenged a sale of the company and successfully settled the matter with a payment to shareholders based on the breach of the Fiduciary Duty of the Officers and Directors. Case resulted in a Two Million Dollar payout for the shareholder class.
Atoll Advisors v. Henry, et. al., Docket No. C-378-10 (Superior Court of New Jersey, Chancery Division: Bergen County) wherein a settlement was obtained for the class and approved by the Hon. Harry G. Carroll Chancery Judge of Bergen County
Capgrowth Group v Barry Lipsky et als, Docket No: BUR C 43-09 (Superior Court of New Jersey, Chancery Division Burlington County) wherein Mr. Lombardi represented a class of shareholders and obtained a settlement approved by the Hon. Michael J. Hogan, JSC

Lemon Bay Partners v Burlington Coat Factory et al., Docket # BUR-C-014-06 (Superior Court of New Jersey, Burlington County) wherein a settlement was obtained for the class and approved by the Honorable Ronald E. Bookbinder then Chancery Judge in Burlington County.
Spring Partners LLC v. Net2Phone Inc. et al., Docket No: ESX-C 0214-05 (Superior Court of New Jersey, Chancery Division: Essex County) wherein The Law Offices of Steven P. Lombardi acted as counsel for the proposed class in a matter ultimately settled in a companion case in Delaware.
Green Meadows Partners, LLP v. Kenney et al., No. HNT-C-1404-04 (Superior Court of New Jersey, Chancery Division: Somerset County) wherein Judge Ruggiero Williams, then Chancery Judge in Somerset County, approved a settlement in a class action litigation wherein The Law Offices of Steven P. Lombardi acted as counsel for the class.
Additionally, in 2001, The Law Offices of Steven P. Lombardi represented a class of litigants in the matter of Bass v De Vink, et. al., a matter litigated before Judge Mackenzie in the Chancery Division of Morris County. This matter litigated through the Appellate Division before being settled. Further, in the matter of Metelman v Donald Trump, The Law Offices of Steven P. Lombardi acted as counsel for the class in a matter litigated in the Chancery Division of Atlantic County before that case was resolved before the Honorable Robert Seltzer in 2001. In 2000 The Law Offices of Steven P. Lombardi was also lead counsel in the class action matter of Prieto v New York Sports Clubs, a matter litigated in Union County, wherein The Law Offices of Steven P. Lombardi obtained a settlement for the class enforcing Lifetime Contractual Agreements of consumers which was approved by the court.
Appellate Experience

In Duffy v Fantasy Island , A 31-2-3428, Mr. Lombardi obtained a favorable appellate ruling which upheld a lower court’s ruling concerning mandatory Arbitration proceedings.
In Bass v DeVink, 336 N.J. Super. 450 (App. Div.), certif. denied, 168 N.J. 292 (2001), Mr. Lombardi argued for class certification over the arguments of the defendants that other filed proceedings should proceed ahead of his client’s claims.
In Bauman v Virgilo, A-5565-04T3 Mr. Lombardi successfully overturned a lower court’s ruling dismissing the plaintiff’s claims based on the Verbal Threshold Statute. The Appellate Division clarified the case law on the proofs required for pre-existing injuries.
In Policastro v Jackson Auto Body, A-000145-09T1, Mr. Lombardi argued a complex commercial Consumer Fraud Act case regarding the damages required to be proven at trial to sustain a claim under the Act.
In Irvington Physical Therapy v Shapiro and Berezin, A-003789-08T1, Mr. Lombardi argued a case involving trial court evidence requirements related to collection actions. This case resulted in remanding back to the trial court a collection matter with instructions to the lower court to accept evidence from an office manager as to the book account billing. This case created precedent used widely since by medical practitioners in their collection efforts.
In Houston v Gichuhi, A-9021-12T3 Mr. Lombardi successfully overturned a Summary Judgment ruling against the Plaintiff. The Appellate court found that lighting in a Commercial Tenement hallway needed to be activated at all times and the defendant could not rely on the injured party to activate the lights by locating the switches.
